The Defender Association of Philadelphia is an independent, non-profit corporation that was created in 1934 by a group of Philadelphia lawyers who were dedicated to the ideal of high quality legal services for indigent criminal defendants.
That ideal continues today, as some two hundred and fifteen full time assistant defenders represent clients in adult and juvenile state and federal trial and appellate courts and at civil and criminal mental health hearings as well as state and county violation of probation/parole hearings. Association attorneys also serve as the Child Advocate in neglect and dependency court.
Although the City of Philadelphia funds it, the Defender Association is not a city or state agency. The Association is directed by a Board of Directors who select the Chief Defender and First Assistant Defender.
EVEN CASUAL VIEWERS of television cop shows know that, in addition to “the right to remain silent,” criminal suspects have “the right to speak to an attorney.”
And, good grief, that’s from the moment police begin serious questioning.
So why, then, do so many Luzerne County children who have been accused of wrongdoing apparently get all the way to the courtroom without legal representation?

Congratulations to Paul Shipp and Kansas Legal Aid for today’s win in In re L.M., No. 06-96197, in which the Kansas Supreme Court found that juveniles have a constitutional right to jury trials in delinquency proceedings. The Juvenile Law Center filed an amicus brief with nine sign-on organizations and individuals from all over the country.

Pennsylvania has no uniform system for assigning indigent defense lawyers, provides no state funding to counties, and collects no data in oversight of county defender services.
